Terms &
Conditions
1. Services Overview
Dreamkid Studio provides digital development, visual production, audio and music production, photography, and brand development services. The specific scope, deliverables, timeline, and pricing for each project are defined in a separate Statement of Work (SOW), project proposal, or service agreement provided to the client prior to commencement of work.
2. Service Agreements
All projects require a signed service agreement, project proposal, or written confirmation (including email) before work begins. Each agreement will outline the project scope, deliverables, timeline, payment schedule, and any project-specific terms. In the event of a conflict between a project agreement and these Terms, the project agreement shall prevail.
3. Client Responsibilities
Clients are responsible for providing all necessary materials, content, feedback, approvals, and access required for project completion in a timely manner. Delays caused by the client in providing materials, feedback, or approvals may result in adjusted timelines and, where applicable, additional charges. Clients warrant that all materials provided to Dreamkid Studio are owned by the client or properly licensed, and do not infringe on the rights of any third party.
4. Intellectual Property
Upon receipt of full payment, the client receives ownership of the final deliverables as specified in the project agreement, unless otherwise stated. Dreamkid Studio retains the right to display completed work in its portfolio, website, social media, and marketing materials unless a non-disclosure agreement is in place. All proprietary tools, code libraries, templates, frameworks, and pre-existing materials developed by Dreamkid Studio remain the intellectual property of Dreamkid Studio and are licensed (not transferred) to the client for use within the scope of the delivered project.
5. Revisions and Scope Changes
Each project includes a defined number of revision rounds as outlined in the project agreement. Additional revisions or changes to the project scope beyond what is outlined in the agreement may incur additional fees, which will be communicated and agreed upon before work proceeds. Significant scope changes may require a revised agreement and adjusted timeline.
6. Payment Terms
All projects require a non-refundable deposit before work begins, typically 50% of the total project cost unless otherwise agreed. Remaining balances are due according to the payment schedule outlined in the project agreement. Invoices are due upon receipt unless otherwise specified. Late payments may incur a late fee of 1.5% per month on the outstanding balance. Dreamkid Studio reserves the right to pause or suspend work on any project with an outstanding balance.
7. Project Timelines
Estimated timelines are provided in good faith based on the project scope. Dreamkid Studio will make reasonable efforts to meet all agreed-upon deadlines. However, timelines may be adjusted due to scope changes, client delays in providing materials or feedback, unforeseen technical challenges, or force majeure events. Dreamkid Studio will communicate any anticipated delays promptly.
8. Limitation of Liability
To the fullest extent permitted by law, Dreamkid Studio and S & C Industries LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from or related to our services. Our total liability for any claim arising from a project shall not exceed the total amount paid by the client for that specific project.
9. Warranty Disclaimer
Services are provided on an "as-is" basis. While we strive for excellence in all deliverables, Dreamkid Studio does not guarantee specific business outcomes, results, or performance metrics such as increased sales, traffic, or engagement unless explicitly guaranteed in a written project agreement.
10. Indemnification
The client agrees to indemnify and hold harmless Dreamkid Studio, and their officers, employees, and contractors from any claims, damages, losses, or expenses arising from the client's use of the deliverables, the client's breach of these Terms, or any third-party claims related to materials provided by the client.
11. Termination
Either party may terminate a project agreement with written notice. In the event of termination, the client is responsible for payment for all work completed up to the date of termination. The non-refundable deposit is retained by Dreamkid Studio regardless of the reason for termination. Upon termination, the client receives all completed deliverables for which payment has been received.
12. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project. This obligation survives the termination of any agreement and remains in effect indefinitely for trade secrets and for a period of two (2) years for other confidential information.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the state in which S & C Industries LLC is registered. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
14. Modifications
Dreamkid Studio reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Privacy
Policy
1. Information We Collect
We may collect personal information that you voluntarily provide to us, including but not limited to your name, email address, phone number, mailing address, company name, and payment information when you contact us, request a quote, engage our services, or subscribe to communications. When you visit our website, we may automatically collect certain information about your device and usage, including your IP address, browser type, operating system, referring URLs, pages viewed, time spent on pages, and other diagnostic data. We may use cookies, web beacons, and similar tracking technologies to enhance your experience on our website, analyze usage patterns, and support our marketing efforts.

We do not sell, rent, or trade your personal information to third parties. We may share your information with trusted service providers who assist us in operating our business (such as payment processors, email services, hosting providers, and analytics tools), but only to the extent necessary for them to perform their services. We may also disclose information if required by law, court order, or government request, or to protect the rights, property, or safety of Dreamkid Studio, our clients, or others.
4. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, use, alteration, or disclosure. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
5. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, comply with our legal obligations, resolve disputes, and enforce our agreements. Project files and deliverables are retained for a reasonable period following project completion to facilitate any follow-up requests.
6. Your Rights
Depending on your jurisdiction, you may have the right to access, correct, update, or delete your personal information; opt out of marketing communications; request a copy of the data we hold about you; and restrict or object to certain processing of your data. 7. Third-Party Links
Our website may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any external sites you visit.
8. Children's Privacy
Our services are not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected personal information from a child, we will take steps to delete it promptly.
9. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be posted on our website with a revised effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated policy.

Refund &
Cancellation
1. Deposits
All projects require a non-refundable deposit to secure your project on our schedule and initiate work. The deposit amount is specified in your project agreement, typically 50% of the total project cost. Deposits are non-refundable once work has commenced, as they cover the cost of resource allocation, project planning, and initial production.
2. Cancellation by Client
Clients may cancel a project at any time by providing written notice (email is acceptable). Upon cancellation, the client is responsible for payment of all work completed up to the cancellation date. If the work completed exceeds the deposit amount, an invoice will be issued for the remaining balance. If the work completed is less than the deposit amount, the difference is not refundable, as the deposit is non-refundable. Any completed deliverables for which payment has been received will be provided to the client.
3. Cancellation by Dreamkid Studio
Dreamkid Studio reserves the right to cancel a project if the client fails to provide required materials, feedback, or approvals within 30 days of request; the client's account has an outstanding balance past 30 days; or the project scope has changed substantially without mutual agreement. In the event Dreamkid Studio cancels for reasons other than client non-compliance, the client will receive a refund for any work not yet completed, minus the non-refundable deposit.
4. Refund Eligibility
Because our services are custom-created and cannot be returned, refunds are handled on a case-by-case basis. Refunds are generally not available once work has begun. If a deliverable is materially deficient from the agreed-upon specifications, Dreamkid Studio will first make reasonable efforts to correct the work at no additional cost. If the issue cannot be resolved, a partial refund may be issued for the specific deliverable in question.
5. Revisions vs. Refunds
Dissatisfaction with creative direction or subjective design preferences does not constitute grounds for a refund. Revision rounds are included in every project for this purpose. Clients are encouraged to provide detailed feedback during revision phases to ensure the final deliverable meets expectations.
6. Digital Deliverables
As a digital services company, all deliverables are provided electronically. Once digital files have been delivered and downloaded by the client, they are considered accepted unless the client notifies us of a material deficiency within 7 business days of delivery.
7. Subscription and Retainer Services
For clients on monthly retainer or subscription plans, cancellation requires 30 days' written notice. Services will continue through the end of the current billing period. No refunds are issued for partial months.

Shipping &
Delivery
1. Digital Delivery
All project deliverables — including websites, applications, designs, video files, audio files, photographs, brand assets, and documents — are delivered electronically. Delivery methods include secure file transfer (cloud-based file sharing platforms), direct deployment to the client's hosting platform or app store, email delivery for smaller files, and access provisioning to client dashboards, CMS platforms, or project management tools.
2. Delivery Timelines
Estimated delivery timelines are established in each project's Statement of Work or service agreement. Timelines vary based on project complexity, scope, and client responsiveness. Dreamkid Studio will communicate progress updates and any anticipated delays throughout the project. Final delivery occurs upon completion of all agreed-upon revision rounds and receipt of full payment.
3. File Formats
Deliverables are provided in industry-standard file formats appropriate to the project type. Specific format requirements should be communicated at the beginning of the project. Common delivery formats include web and app projects (deployed live, with source code if specified), video (MP4, MOV, or as specified), audio and music (WAV, MP3, or as specified), photography (JPEG, PNG, TIFF, or RAW as specified), and design and brand assets (PDF, AI, PSD, SVG, PNG as specified).
4. Acceptance of Deliverables
Clients have 7 business days from delivery to review deliverables and notify Dreamkid Studio of any material deficiencies from the agreed-upon scope. Deliverables not contested within this period are considered accepted. This does not affect any revision rounds remaining in the project agreement.
5. Physical Media
In rare cases where physical media (USB drives, hard drives, printed materials) is requested, shipping costs are the responsibility of the client and will be quoted separately. Physical media is shipped via a carrier of the client's choosing, with tracking provided. Dreamkid Studio is not responsible for loss or damage during transit once the package is in the carrier's possession.
